Terms & Conditions for Van Sickle Construction, LLC

Van Sickle Construction, LLC is a general contractor business located at 110 W 2nd Street, Medford OR 97501. We provide a range of construction and contracting services, including but not limited to, residential construction, commercial construction, remodeling, renovations, and project management. Specific details regarding services for any given project will be outlined in a separate, written contract or agreement between Van Sickle Construction, LLC and the client.
2. Client Responsibilities
Clients engaging with Van Sickle Construction, LLC agree to:

Provide accurate and complete information necessary for project execution.

Ensure timely access to the project site as required.

Make timely payments as per the agreed-upon schedule in the project contract.

Cooperate with Van Sickle Construction, LLC personnel and subcontractors to facilitate the smooth progress of the project.

Obtain and maintain any necessary permits or approvals unless otherwise explicitly agreed upon in writing.
3. Project Agreements and Scope of Work
All projects undertaken by Van Sickle Construction, LLC will be governed by a separate, detailed written contract or agreement. This contract will specify the scope of work, project timeline, payment schedule, materials, warranties, and any other specific terms relevant to that particular project. In the event of a conflict between these general Terms & Conditions and a specific project contract, the terms of the project contract shall prevail.
4. Payment Terms
Payment terms, including deposit requirements, progress payment schedules, and final payment, will be clearly defined in the individual project contract. Failure to adhere to the agreed-upon payment schedule may result in project delays, suspension of work, or termination of the contract, subject to the terms outlined in the project agreement.
5. Warranties
Any warranties provided by Van Sickle Construction, LLC regarding workmanship or materials will be explicitly stated in the individual project contract. We will adhere to all applicable building codes and industry standards. Manufacturer warranties for materials and equipment installed will be passed through to the client where applicable.
6. Intellectual Property
The content, features, and functionality of this website are and will remain the exclusive property of Van Sickle Construction, LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Van Sickle Construction, LLC.
7. Limitation of Liability
In no event shall Van Sickle Construction, LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

You agree to defend, indemnify and hold harmless Van Sickle Construction, LLC and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, by you or any person using your account and password; or b) a breach of these Terms.
10. Governing Law
These Terms shall be governed and construed in accordance with the laws of Oregon, United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
